Welcome to Bella Construction & Development Inc. (“Bella Construction,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our website at www.mybellaroof.com (the “Site”), our quote-request forms, our automated and human communications, and any services we provide through them (collectively, the “Services”). By accessing the Site or using the Services, you (“you” or “User”) agree to be bound by these Terms. If you do not agree, please do not use the Site or the Services.
1. Eligibility
You must be at least 18 years old and located in the United States to use the Site or request our Services. By using the Site, you represent that you meet these requirements and have the legal capacity to enter into a binding contract.
2. Description of Services
Bella Construction is a Pennsylvania-licensed contractor offering roofing, siding, gutter, window, door, and related exterior construction and repair services in the greater Pittsburgh region. The Site provides general information about our services and a means to request an estimate. Submitting a request through the Site does not create a binding contract for services; any work undertaken will be governed by a separately signed written agreement between you and Bella Construction.
3. Communications, Automated Messaging, and SMS Consent
When you submit a quote request, contact us by phone, message us through a third-party lead platform, or otherwise initiate communication with us, you provide information including your name, address, phone number, email, and project details. By doing so, you:
Consent to be contacted by Bella Construction and its automated messaging systems by phone, SMS/text message, or email regarding your inquiry and related services;
Acknowledge that initial replies are drafted by an artificial-intelligence-powered conversational assistant named “Bella”; messages are subject to internal review, and a human team member will follow up to confirm project details and scheduling;
Understand that standard message and data rates may apply for SMS communications;
Agree that you may opt out of SMS communications at any time by replying STOP to any text message we send; you may also request to opt out of email or phone contact by emailing us at the address in Section 17;
Confirm that the contact information you provide is accurate and that you have the legal right to provide it.
Consent to receive automated communications is not a condition of purchase. You may request a quote and use our Services without separately consenting to marketing messages, but you must permit us to respond to inquiries you initiate.
4. Third-Party Lead Sources
You may have first contacted Bella Construction through a third-party platform (for example, Google Local Services Ads, HomeAdvisor, Angi, or a similar service). Your use of those platforms is governed by the respective platform’s own terms; Bella Construction is not responsible for the content, practices, or policies of those platforms.
5. Acceptable Use of the Site
You agree not to:
Use the Site for any unlawful purpose or in violation of any applicable federal, state, or local law;
Submit false, misleading, fraudulent, or stolen information through any form;
Attempt to gain unauthorized access to the Site, its servers, our databases, or any related systems;
Interfere with or disrupt the operation of the Site, including by introducing viruses, malware, or excessive automated traffic;
Use any automated means (scrapers, bots, AI agents, harvesters, etc.) to access, copy, or extract content or contact information from the Site without our prior written consent;
Reproduce, distribute, modify, or create derivative works of any Site content without our prior written consent.
We reserve the right to refuse service, restrict access, or remove content at our sole discretion.
6. Intellectual Property
All content on the Site — including text, photographs of completed projects, logos, brand designs, and the “Bella Construction & Development” name and marks — is owned by or licensed to Bella Construction and is protected by United States copyright and trademark law. You may not use any of this content without our prior written consent, except for personal, non-commercial review of the Site.
7. Estimates, Pricing, and Project Scope
Any estimates, project ranges, or pricing information provided on the Site or in response to a request are preliminary and non-binding. Final pricing for any project will be set forth in a written contract signed by both parties. Estimates may change based on conditions discovered during on-site inspection, scope changes you request, material-cost fluctuations, permit requirements, or other factors disclosed in the signed contract.
8. Privacy
Your use of the Site and the Services is also governed by our Privacy Policy, available at www.mybellaroof.com/privacy and incorporated into these Terms by reference. The Privacy Policy describes what information we collect, how we use and store it, the third-party services we share it with, and your rights regarding that information.
9. Third-Party Links and Services
The Site may contain links to third-party websites or services. Those links are provided for convenience only. Bella Construction does not endorse and is not responsible for the content, accuracy, or practices of any third-party site.
10. Disclaimers
THE SITE AND ALL CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Bella Construction does not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
Nothing on the Site constitutes legal, financial, structural-engineering, or insurance advice. For specific structural, safety, or insurance questions, please consult a qualified licensed professional.
11. Limitation of Liability
To the maximum extent permitted by law, Bella Construction, its officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities, arising out of or in connection with your use of the Site or Services, even if Bella Construction has been advised of the possibility of such damages.
Bella Construction’s total aggregate liability arising out of or in connection with the Site or these Terms shall not exceed one hundred U.S. dollars (US $100.00). This Section 11 does not apply to liability arising under a separately signed construction contract — that contract’s terms govern liability for work performed.
12. Indemnification
You agree to defend, indemnify, and hold harmless Bella Construction and its officers, employees, and agents from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising out of (a) your violation of these Terms, (b) your misuse of the Site, or (c) any information you submit through the Site that is false, misleading, or that you did not have the right to provide.
13. Governing Law and Venue
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Site shall be brought exclusively in the state or federal courts located in Westmoreland County or Allegheny County, Pennsylvania, and you consent to the personal jurisdiction of those courts.
14. Changes to These Terms
We may update these Terms from time to time. The “Effective Date” at the top will reflect the most recent revision. Material changes will be reasonably highlighted on the Site. Your continued use of the Site after a change becomes effective constitutes your acceptance of the revised Terms.
15. Severability
If any provision of these Terms is held by a court of competent jurisdiction to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
16. Entire Agreement
These Terms, together with our Privacy Policy and any separately signed construction contract, constitute the entire agreement between you and Bella Construction regarding your use of the Site and the Services, and supersede any prior agreements on those subjects.
